I live and Maryland and would like to know the penalty for filing a false police statement?

Also, the person has no record and was intoxicated when the statement was taking by the officer. What may happen to my friend and, what is the max. penalty she can receive for this and also what do you think her penalty may be since she has no record?I live and Maryland and would like to know the penalty for filing a false police statement?

The charge is known in Maryland as ';搂 9-501. False statement - To law enforcement officer.';





To break this law, you have to knowingly make the report with intent to deceive. Being drunk is not a total defense, but it will come down to what the person actually said. For example, if they filed a report that a purple hippo robbed them at gunpoint, it would likely be easy to prove that the person was so intoxicated that they really thought what they reported was true at the time. This isn't a crime per se. But if there is evidence of a specific motive for making the false report, for example that the bouncer that threw the person out of the bar also sexually assaulted them too (meaning, the false report was motivated to hurt someone on purpose), then they could face the maximum punishment.





In Maryland, the maximum sentence for this crime is 6 months in jail and/or a fine of $500. The maximum is all I can tell you, because it is IMPOSSIBLE for us here on Y!A to make an informed sentencing prediction without knowing the details of the entire case soup to nuts.
Probation is a possibility but this is a serious crime, you're going to probably do some jail time...um, I mean, ';your friend.'; When you make false statements to the cops, do you think you're going to get away with it? It's one of the dumbest things you can do, I never understood the thought process behind this, but then again, why are you committing crimes in the first place? I mean, ah...your 'friend.';
Probably just probation. But get a good lawyer, more than likely the DA will push for the max.
